Official Rules for Contest on TikTok
NO PURCHASE NECESSARY TO ENTER OR WIN. This Contest (the “Contest”) is sponsored by VACAYA, LLC. A Delaware company (“Sponsor”), 2020 Pennsylvania Ave. NW Suite 290. Washington DC 20006.
Sponsor may offer a similar Contests from time to time. Each offer is separate. Entry into each Contest is separate. The start/end time, how to enter and available prize for each Contest will be listed in the offer for that Contest on Sponsor’s webpage at https://www.myvacaya.com/. The other terms below will apply to each Contest. Many may enter; only one will win.
1. ELIGIBILITY: Open only to legal residents of the fifty (50) United States and the District of Columbia, who are 18 years of age or older at time of entry. Eligible Entrants who are under the legal age of majority in their state of primary residence (a “Minor”) must get their parent or legal guardian’s permission to participate in the Contest but are not eligible to win the prize. For wireless phone entrants, carrier message and data rates, may apply. Void where prohibited by law. All applicable federal, state and local laws apply.
2. HOW TO ENTER: Entry does not require a payment or a purchase of any kind. To enter the Contest, an Entrant must have a TikTok account. If you do not have a TikTok account you may create one for free by visiting www.tiktok.com. By submitting your information and creating an account, you agree to the terms of use and privacy policy of TikTok. If you do not agree to such terms of use and privacy policy, you cannot create an account or participate in this Contest. Sponsor may not receive Entries from TikTok users with “private” updates (i.e., Entrant has set his or her account so that only people the Entrant has approved can view his or her updates.) If Entrant is using his or her mobile device to enter, charges, including message and data rates, may apply. Entrants should consult their wireless service provider regarding its pricing plans. This contest is in no way sponsored, endorsed, administered by, or associated with, TikTok.
To enter, follow Sponsor’s TikTok account as indicated and respond to any Contest offer posted by Sponsor on its web page at https://www.myvacaya.com/ by “Tagging” “Liking,” “Commenting” or otherwise responding in the manner and time period set forth in the offer (the “Entry Period”). The “Like,” or “Comment,” “Tag” or other required response must include all information required in the offer. Limit one (1) entry per unique TikTok account and per person per Contest. Entries generated by script, macro or other automated means are void, as are entries that are illegible, garbled, incomplete or that contain errors. Normal time, toll, connection and usage rates, if any, charged by your Internet service provider will apply. All entries become the property of the Sponsor. No other entry method will be accepted.
Copyright Infringement: We don’t require or allow a contestant in the TikTok contest to use music, photos, logos or any other copyrighted material they don’t own to produce their entry.
3. WINNER SELECTION: Winner(s) will be selected in each Contest by random drawing from amongst all eligible entries received. Proof of transmission is not proof of receipt. Sponsor’s computer is the official time-keeping device for the Contest and determines the order of receipt of entries. All decisions of the Sponsor are final and binding with respect to all matters related to the Contest.
4. WINNER NOTIFICATION/VALIDATION: The potential Winner will be asked for an eligible email address by Direct Message and will then be notified by email and may be required to execute and return an Affidavit of Eligibility/Release of Liability/Publicity (where legal) form within seven (7) days of date of attempted notification. If winner is a Minor, the prize will be forfeited to the next randomly selected entrant 18+. Noncompliance within this time period, with these Official Rules or the return of any prize/prize notification may result in disqualification and, at Sponsor’s discretion, an alternate potential winner may be selected by Sponsor. Prizes will be fulfilled approximately 4-6 weeks after winner validation. Any winner later determined to be ineligible may be required to return his/her prize. Any taxes on prize are the responsibility of the winner.
5. PRIZE AND ODDS: The prize mentioned in the Contest offer is the only prize available. No transfer, substitution or cash redemption will be awarded in lieu of stated prize except by Sponsor who reserves the right to substitute a prize (or portion thereof) of comparable or greater value, in its sole discretion, if the advertised prize becomes unavailable. All prize details are at the sole discretion of the Sponsor. Odds of winning depend on number and timing of entries received in each Contest. Contest is open to over 100,000,000 internet users in the United States.
6. PRIZE: One (1) Prizewinner during the Sweepstakes Period will receive an email confirmation (and possibly a phone call) to receive finalize his/her reservation for the cruise prize. Prize includes a double-occupancy Room for Prize Winner and travel guest on the specific VACAYA LGBT+ Cruise listed below and is non-transferable in any way to another person, sailing date or ship.

Event Date: January 10-17, 2022 (or it’s replacement)
Cruise Ship: Celebrity Millennium (or it’s replacement)
Approximate retail value (“ARV”) of the following cruise is $3300 USD. No Cash Value. Any taxes on contest prize are the responsibility of the winner.
Approximate Retail Value (“ARV”) of Prize will be finalized at time of booking. Any difference between stated and actual value will not be awarded. Prize consists room fare, standard meals, standard non-alcohol drinks. All other expenses not expressly provided for herein including, but not limited to, taxes, fees, other gratuities, airfare, ground transportation, shore excursion fees, alcoholic beverages, onboard expenditures, premium dining, spa treatments, duty-free shopping, soft drinks, gambling, and any other incidental costs or other expenses not specifically set forth herein are the sole responsibility of Prizewinner and/or Travel Guest. All travel is capacity controlled and subject to availability. Prizewinner and Travel Guest must travel on same itinerary. Travel Guest must (or Travel Guest’s parent or legal guardian if Travel Guest is an a person between the ages of 18-21 in his/her state/province of residence) sign and return a valid VACAYA reservation confirmation and release before any ticketing of travel occurs. Prizewinner and Travel Guest must: (i) have all necessary identification and/or travel documents (including but not limited to a valid passport (and Visa(s) if required for travel; and (ii) comply with all check-in requirements, including, but not limited to, the presentation of a major credit card. No cash redemptions. Any portion of the Prize not accepted by Prizewinner will be forfeited, and Celebrity Cruise Line shall not be responsible for any inability of Prizewinner to accept or use any portion of the Prize for any reason. Other limitations and restrictions may apply. Prize is non-transferable, cannot be substituted (except at the sole discretion of Sponsor who reserves the right to substitute a prize of equal or greater value), and may not be sold or combined with any other offer. Prize is subject to the terms and conditions set forth in these Official Rules and any set forth and detailed by the Cruise Line. If Prize is cancelled after ticketing of Prize, for any reason, Sponsor reserves the right to substitute a prize of equal or greater value. Additional guests and room category upgrades are subject to availability at the sole discretion of VACAYA and at the sole cost of Prizewinner. No refund or credit shall be provided for stateroom downgrades. Category restrictions and exclusions, and standard cancellation policy apply. Prize may not be valid where restricted by law. Offer is not combinable with any other coupon or promotion. VACAYA is not responsible for lost or misdirected mail. No transfer, cash equivalent, or Prize substitution allowed, except at Sponsor’s sole discretion. Sponsor may require winner(s) to sign an affidavit of eligibility and liability/publicity release. Decisions made by Sponsor are final in all matters, including interpretation of these official rules and awarding of the Prize(s). If legitimately claimed, the Prize(s) will be awarded. In no event will more than the stated number of Prize(s) be awarded. All expenses not specified herein, including, without limitation, all federal, state and local taxes, are each winner’s sole responsibility.
7. GENERAL RULES: Acceptance of prize constitutes permission to the Sponsor and its designees to use each winner’s name, city, state, likeness, voice, biographical information and statements for purposes of advertising, promotion and publicity in any and all media, now or hereafter known, throughout the world in perpetuity without additional compensation, notification or permission, unless prohibited by law. By participating, entrant (i) agrees to release and hold Sponsor, and its parent, affiliates, subsidiaries, and advertising and promotion agencies, Celebrity Cruise Lines, and each of their respective directors, officers, employees and assigns (collectively, the “Released Parties”), harmless against any and all claims and liability arising in whole or in part, directly or indirectly, out of participation in the Contest or misuse, nonuse or use of any prize; (ii) waives all rights to claim punitive, incidental and consequential damages, attorneys’ fees or any damages other than actual out-of-pocket costs incurred to enter; and (iii) agrees to be bound by these Official Rules. Released Parties are not responsible for incomplete, lost, late, damaged, inaccurate, illegible, misdirected, garbled, delayed or undelivered entries or referrals; or for technical hardware or software malfunctions or failures of any kind, lost, unavailable network connections, or failed, incomplete, garbled or delayed computer transmission, which may limit an individual’s ability to participate. Sponsor reserves the right in its sole discretion, to cancel, suspend or modify the Sweepstakes, or to disqualify any implicated entrant(s), (and their entries) if any fraud, virus, actions by entrants, technical or other error or problem, or any other occurrence corrupts or affects the administration, integrity, security, or proper play of the Contest, as determined by Sponsor in its sole discretion. In the event of cancellation, Sponsor reserves the right, at its sole discretion, to award the prize in a random drawing from among all eligible, non-suspect Entries received up to the time of the event or action warranting such cancellation. In the event the Contest is cancelled prior to the stated end date, a notice will be posted at https://www.myVACAYA.com.
CAUTION: Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Contest is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek damages from any such entrant to the fullest extent permitted by law, including criminal prosecution. In the event a dispute arises regarding a specific individual entitled to receive a prize, entries will be declared made by the authorized account holder of the TikTok account submitted at the time of entry and any damage made to the web site will also be the responsibility of the authorized account holder. “Authorized account holder” is defined as the person who is assigned to a TikTok account name by TikTok. Released Parties are not responsible for any technical, mechanical, printing, typographical, human or other error relating to or in connection with the Contest, including, without limitation, errors which may occur in the administration of the Contest, the processing of entries, the announcement of the prize or in any Contest-related materials; or for any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Contest.
8. NO WARRANTIES: Sponsor makes no warranties covering any of the prizes furnished as part of this Contest. Any prize, and all materials furnished as part of or in connection with this Contest are provided “as is” without warranty of any kind, either express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose.
9. GOVERNING LAW: This Contest and the rights and obligations of the Sponsor and participants will be governed by and controlled by the laws of the Delaware, applicable to contracts made and performed therein without reference to the applicable choice of law provisions. All actions, proceedings, or litigation relating hereto will be instituted and prosecuted solely within the State of Delaware. The parties consent to the jurisdiction of the state courts of Delaware and federal court located with such state and county with respect to any action, dispute, or other matter pertaining to or arising out of this Contest
10. PRIVACY: Winner’s name and contact information will be used in order to contact winner for the purpose of fulfillment of prizes. Any information submitted to Sponsor, including all Entries will be governed by the terms of Sponsor’s User Agreement and Privacy Policy.
11. NO IMPLIED ENDORSEMENT: The names of individuals, groups, companies, products and services mentioned herein, and any corresponding likenesses, logos and images thereof reproduced herein, have been used for identification purposes only and may be the copyrighted properties and trademarks of their respective owners. The mention of any individual, group or company, including TikTok or the inclusion of a product or service as the prize, does not imply any association with or endorsement by such individual, group or company or the manufacturer or distributor of such product or service and, except as otherwise indicated, no association or endorsement is intended or should be inferred.
12. WINNER NAME. Name of winner (first name / city) will be posted on the Sponsor’s web page https://www.myvacaya.com/ when available.
